One of the topics that our foreign investors are concerned about is employment. Employment that takes place in Korea is subject to application of the provisions under the labor related laws and regulations in the Rep. of Korea, such as the Labor Standard Act and Minimum Wage Act, irrespective of whether the employee is a foreigner or the employment is part-time or fix-term.<\/span><\/p>\r\n

The labor laws of the Rep. of Korea favor employees in comparison to those in the U.S., at least in the aspect of employment termination.<\/span><\/p>\r\n

In the State of New York, as in most U.S. states, employment is generally “at-will,” meaning that either the employer or the employee can terminate the employment relationship at any time, for any reason, or for no reason at all, as long as the reason is not illegal (e.g., discrimination, retaliation, violation of public policy, breach of contract, and constructive discharge).<\/span><\/p>\r\n

In contrast, the labor laws of the Rep. of Korea require employers to have “justifiable cause” to terminate an employment relationship. The standard of review for a justifiable cause is rather high. For example, the courts will find a justifiable cause where the employee\u2019s conduct amounts to criminal acts against the company such as embezzlement, breach of trust, theft, or causing a serious accident due to negligence. If insubordination is asserted as grounds for termination, the order that was not followed has to be justifiable. Moreover, employers are required to provide 30 days\u2019 notice or pay in lieu of notice before terminating an employee, which is a protection not typically found in New York.<\/span><\/p>\r\n

In accordance with the FLSA (Fair Labor Standard Act), the standard workweek in the U.S. 40 hours, and any hours worked beyond that must be compensated as overtime at a rate of 1.5 times the regular pay in general. In N.Y., the ten-hour rule would apply in addition to the overtime payment. However, generally speaking, there are no regulations, federal or state, that place a cap on the total number of hours an employee can work per week; although there are limited exceptions such as the 24-hour break rule which applicable only in certain sectors of industry.<\/span><\/p>\r\n

In contrast, the Rep. of Korea has a legal cap on the workweek, set at 52 hours (40 regular hours and up to 12 hours of overtime). Employers cannot require employees to work more than this without facing legal consequences, unless an exception applies. Overtime pay is also at least 1.5 times the regular wage, with additional premiums for night work and holidays.<\/span><\/p>\r\n

In the U.S., generally speaking, there are no federal laws that mandate paid vacation or sick leave for employees. The FMLA (Family and Medical Leave Act) does provide job-protected leave for certain family and medical reasons; however, this leave is generally unpaid. Some states and localities have their own laws requiring paid sick leave or paid family and medical leave. However, these requirements vary widely by jurisdiction. The State of New York requires certain employers to provide paid sick leave depending on the size and net income of the company.<\/span><\/p>\r\n

In contract, the labor laws of the Rep. of Korea mandates at least 15 days of paid annual leave after one year of employment, with the number of leave days increasing with longer service.
